Terms of Service

These terms are an agreement between you and ToNi Tech Games (“WordQuest”, “we”, “us”) for your use of the WordQuest game and website. By creating an account or playing, you agree to them.

1. Who can play

You must be at least 16 years old to use WordQuest, and you must be able to enter into this agreement. If you use WordQuest on behalf of someone else, you confirm you're allowed to.

2. Your account

  • Give accurate information when you sign up and keep it up to date.
  • Keep your password secret — you're responsible for activity on your account.
  • One person, one account. Don't impersonate others or pick a username that's offensive or infringes someone's rights.
  • Tell us promptly if you think your account has been compromised.

3. Fair play and acceptable use

When using WordQuest, you agree not to:

  • Cheat, use bots or automation, exploit bugs, or otherwise gain an unfair advantage in games, duels, tournaments or leaderboards.
  • Harass, abuse, threaten or harm other players.
  • Post unlawful, hateful or infringing content (for example in your username or bio).
  • Attempt to access accounts, data or systems you're not authorised to, or disrupt or overload the service.
  • Reverse-engineer, scrape or copy the service except as allowed by law.

4. Points and virtual items

WordQuest includes in-game points (“WQ Points”) and virtual items such as shop unlocks, energy refills, hints and cosmetic frames. You can earn these by playing, and you can also buy them — see section 5.

However you obtain them, WQ Points and virtual items are a limited, personal, non-transferable licence to use a feature inside the game. They have no real-world monetary value, cannot be exchanged for cash, cannot be sold or transferred to another player or account, and are not your property. We may adjust, expire or remove in-game items, and change what things cost in points, as part of running and balancing the game.

5. Buying points and Premium

Some things in WordQuest can be bought with real money: packs of WQ Points, and a Premium membership. Prices are always shown before you confirm, in your own currency, and include any applicable VAT.

Who you are buying from depends on where you buy.

  • In our iPhone or Android app — your purchase is made through Apple's App Store or Google Play. They are the seller for that transaction, they take the payment, and their own terms and refund policies apply alongside these terms.
  • On our website — your purchase is handled by our payment provider, who is named on the checkout page before you pay. We never see or store your full card details.

Buying points does not guarantee that any particular item will remain available, and points bought are subject to section 4 in exactly the same way as points earned.

6. Premium is a recurring subscription

Premium is offered as a monthly or yearly subscription. Please read this section carefully, because it renews on its own.

  • It renews automatically at the end of each period, at the then-current price, until you cancel. You are charged for the next period at the start of it.
  • To stop it, cancel at least 24 hours before the current period ends. Cancelling in time prevents the next charge; cancelling later does not refund the period already started.
  • If you bought it in the app, cancel it in your App Store or Google Play account settings — uninstalling the app does not cancel a subscription, and neither does deleting your WordQuest account. If you bought it on our website, you can cancel from your WordQuest settings.
  • When you cancel, you keep your Premium benefits until the end of the period you have already paid for.
  • If we change the price, we will tell you in advance and you will be asked to agree before any higher price is charged. If you do not agree, the subscription simply ends at the end of the current period.
  • Premium benefits are gameplay conveniences — a higher energy cap, faster energy regeneration, an XP bonus, a daily hint and a cosmetic aura. They do not guarantee wins, rankings or rewards, and we may change what is included, giving reasonable notice where a change is significant.

7. Refunds and your right to withdraw

If you bought through the App Store or Google Play, refunds are handled by them under their policies, not by us. We are happy to help you with a request, but we cannot issue those refunds ourselves.

For purchases made on our website, EU and Dutch consumer law normally gives you 14 days to withdraw from a distance contract. There is an important exception for digital content, and it applies here. Because points and Premium are delivered to your account immediately, we ask you at checkout to expressly consent to immediate delivery and to acknowledge that you therefore lose your 14-day right of withdrawal once delivery begins. If you would rather keep that right, do not tick the box — simply do not complete the purchase.

Nothing here affects your legal rights if something we sold you is faulty, not delivered, or not as described. If points or Premium you paid for do not arrive, contact us and we will fix it or refund it.

If a payment is reversed or charged back after we have already credited your account, we may remove the corresponding points or Premium time.

8. Our content

WordQuest, including its name, logo, design, text and software, belongs to us or our licensors and is protected by intellectual-property laws. We grant you a personal, non-exclusive, non-transferable right to use the service for your own enjoyment under these terms. Content you add (such as your username or bio) stays yours, but you give us permission to display it within the service as needed to run it.

9. Suspension and ending your account

You can delete your account at any time from Settings or from our account-deletion page. We may suspend or close an account that breaks these terms or that we reasonably believe is being used to harm other players or the service. Where it's fair to do so, we'll try to let you know.

Deleting or losing access to your account ends your licence to any WQ Points and virtual items on it, including ones you paid for, and they are not refunded — except where the law says otherwise, or where we closed your account without good reason. Deleting your WordQuest account does not cancel a subscription bought through the App Store or Google Play — cancel that in your store account settings as described in section 6, or you will keep being charged.

10. Advertising

WordQuest may offer optional rewarded adverts — you choose to watch a short video in exchange for an in-game reward. You never have to watch one, and the game is fully playable without them. Where the law requires your consent for advertising cookies or similar technologies, we ask for it first, and declining does not stop you playing. 11. The service is provided “as is”

We work hard to keep WordQuest running well, but we provide it “as is” and can't promise it will always be available, uninterrupted or error-free. We may change, suspend or discontinue features at any time. If we permanently discontinue a paid feature you are subscribed to, we will give reasonable notice and refund any period you have paid for but cannot use.

12. Limitation of liability

Nothing in these terms limits any rights you have that can't be limited by law — including our responsibility for death or personal injury caused by our negligence, for fraud, and for goods or services not being as described. Subject to that, and to the extent the law allows, we are not liable for indirect or consequential losses, or for loss of in-game points or items, arising from your use of the service. Where we are liable for a paid purchase, our liability is limited to the amount you paid us for it in the twelve months before the claim.

13. Changes to these terms

We may update these terms from time to time. If we make a significant change we'll update the date above and, where appropriate, notify you in the app or by email. Continuing to play after a change means you accept the updated terms. If a change affects a subscription you are already paying for, we will tell you before it applies to you.

14. Governing law

These terms are governed by the laws of the Netherlands, and any disputes will be subject to the courts of the Netherlands, unless mandatory consumer-protection law in your country of residence says otherwise.
